Terms of Service

1. Who can use KoberTag

You must be at least 18 years old to use KoberTag. By creating an account, you confirm that you are 18 or older and legally able to enter into contracts.

KoberTag is intended for professional use. Individual accounts are for one person; team accounts allow the number of users specified in your plan.

2. Your account

You are responsible for:

• Providing accurate registration information
• Maintaining the security of your password
• All activity that occurs under your account

3. Acceptable use

You agree not to:

• Use KoberTag for any illegal purpose
• Upload content you don't have the right to use
• Reverse engineer, decompile, or attempt to extract source code
• Interfere with the operation of KoberTag or other users
• Use automated tools to access KoberTag except as permitted by our API (currently none)
• Resell or sublicense access to your account without our consent
• Share account credentials with others outside your allowed team size

4. Content ownership

You retain full ownership of everything you upload to KoberTag: your PDFs, price lists, estimates, and any other content. We do not claim ownership of your content.

You grant KoberTag a limited license to process your content solely for the purpose of providing the service to you (e.g., extracting codes from PDFs, generating estimates, storing your data).

5. Subscription and billing

KoberTag operates on a monthly subscription model with usage-based billing:

• You pay a monthly subscription fee based on your chosen tier
• Each tier includes a monthly usage allowance
• Usage beyond your allowance is billed for the usage you consume, up to a maximum monthly cap
• All fees are in US dollars
• Subscriptions renew automatically each month

You can change plans or cancel anytime from your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial months.

6. Free trial

New users can try KoberTag with a free trial before subscribing. The trial is limited to a set number of analyses (10), not by time. When you have used your trial analyses, you must subscribe to continue using KoberTag. We do not automatically charge you at the end of the trial without your explicit consent.

7. Service availability

We aim to keep KoberTag available at all times but do not guarantee uninterrupted service. Scheduled maintenance, unexpected downtime, or issues with third-party providers may cause temporary unavailability. We will make reasonable efforts to minimize disruption.

8. KoberTag's rights

We reserve the right to:

• Modify or discontinue features of KoberTag
• Suspend or terminate accounts that violate these terms
• Refuse service to anyone at our discretion
• Change our pricing with 30 days' notice for existing customers

9. Limitation of liability

KoberTag is provided "as is" without warranties of any kind. We do not guarantee that the estimates or reports generated by KoberTag will be error-free. You are responsible for reviewing all outputs before using them in commercial transactions.

To the maximum extent permitted by law, KoberTag (and its operator, COMPANYSUN) shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify KoberTag against any claims arising from:

• Your violation of these terms
• Your violation of any third-party rights
• Content you upload or generate through KoberTag
• Your use of KoberTag in violation of applicable laws

11. Termination

You can terminate your account at any time by canceling your subscription. We can terminate accounts that violate these terms.

Upon termination, your access to KoberTag will end. Your data will be retained per our Privacy Policy.

12. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify you by email and require you to acknowledge the updated terms in the application before continuing to use KoberTag. Continued use after acknowledgment constitutes acceptance of the new terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Florida, USA. Any disputes arising from these terms or your use of KoberTag shall be resolved in the state courts located in Florida.
